- concealed or unexpected defects

The scope, inclusions, exclusions, payment terms and specific conditions applying to work will be provided in the relevant quotation, proposal, booking confirmation or contract.
Additional work or variations will be discussed with the customer and approved before proceeding, where reasonably practicable.
Service and attendance fees
A service, attendance, inspection or diagnostic fee may apply where disclosed at the time of enquiry, booking or attendance.
This fee may cover travel, technician attendance, investigation, assessment and professional advice. It may remain payable where the customer chooses not to proceed with further work.
Where a promotion or no-attendance-fee offer applies, the specific eligibility requirements and exclusions will be disclosed as part of that offer.
Payment
Payment terms will be stated in the relevant quotation, invoice or contract.
Unless otherwise agreed in writing, payment for service and maintenance work is due upon completion.
Deposits or progress payments may apply to larger work, projects, special-order materials or work requiring permits and inspections.
All deposits, progress payments and domestic building payment arrangements will be managed in accordance with applicable Victorian legislation.
Cancellations and property access
Customers must provide reasonable and safe access to the property and relevant work areas at the scheduled time.
Customers should provide at least 24 hours’ notice when cancelling or rescheduling an appointment.
A reasonable cancellation, attendance or rescheduling fee may apply where:
- insufficient notice is provided
- a technician has already been dispatched
- access to the property is unavailable
- the site is unsafe or not ready for the work, or
- labour, equipment or materials have been specifically allocated
Any fee will be applied only to the extent permitted by law and will reflect the reasonable costs incurred.
Existing and concealed conditions
Quotations and service recommendations are based on the conditions visible and reasonably identifiable at the time of inspection.
Additional work or costs may arise where we identify:
- concealed damage or deterioration
- defective or non-compliant existing work
- asbestos or other hazardous materials
- inaccessible services
- structural issues
- underground obstructions
- damaged or collapsed pipework
- unsafe electrical or plumbing installations, or
- other conditions that could not reasonably have been identified beforehand
Where practicable, we will explain the issue and obtain approval before completing additional work.
We may stop or suspend work where continuing would be unsafe, unlawful or likely to cause damage.
Australian Consumer Law
Nothing in these Terms of Use excludes, restricts or modifies any right, guarantee or remedy available
under the Australian Consumer Law or other applicable legislation.
Our goods and services come with consumer guarantees that cannot be excluded under Australian law.
Any warranty provided by O’Shea Trades operates in addition to, and does not replace, your statutory
rights.
Limitation of liability
To the maximum extent permitted by law:
- we are not responsible for loss arising from reliance on general website information without a property- specific assessment
- we are not responsible for defects or damage outside the agreed scope of work
- we are not responsible for pre-existing or concealed defects that could not reasonably have been identified, and
- we exclude liability for indirect or consequential loss that was not reasonably foreseeable
These limitations do not apply to any liability, consumer guarantee, right or remedy that cannot lawfully be excluded or limited.
